1. General Information

These Terms & Conditions ("Terms") govern your access to and use of medplan.live ("Platform"). The Platform is owned and operated by Tymera Software LLC ("Company"). By using the Platform, you agree to these Terms.

2. Service Description

medplan.live is a subscription-based SaaS platform that allows clinics to create and manage work schedules. Users subscribe on a monthly, automatically renewed basis.

3. Subscription and Payments

  • Payments are processed via Stripe using credit cards.
  • Subscriptions renew automatically.
  • Users may cancel at any time; no refunds are issued for the current billing period.

4. User Responsibilities

  • You are responsible for keeping your login credentials confidential.
  • You are responsible for the accuracy of the data you input into the platform.
  • The Company reserves the right to suspend accounts in case of misuse.

5. Intellectual Property

All content, design, and code on the Platform are owned by Tymera Software LLC. Unauthorized copying or distribution is prohibited.

6. Limitation of Liability

  • The Company does not guarantee uninterrupted or error-free service.
  • Tymera Software LLC shall not be liable for indirect damages or data loss.

7. Modifications

The Company may update these Terms at any time. Updates become effective upon publication on the Platform.

8. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA.

9. Data Privacy and Security

  • We collect and process personal data including user account information and doctor phone numbers.
  • All sensitive data, including phone numbers, is encrypted using industry-standard encryption protocols.
  • User data is stored on secure servers and is only accessible to authorized personnel.
  • We comply with applicable data protection laws, including GDPR and KVKK where applicable.
  • In the event of a data breach, affected users will be notified within 72 hours.
  • Users have the right to access, correct, or delete their personal data at any time.

10. Account Termination

User-Initiated Termination:

  • Users may cancel their subscription at any time through their account settings.
  • Upon cancellation, access continues until the end of the current billing period.
  • After cancellation, user data is retained for 30 days and then permanently deleted.
  • Users may request immediate data deletion by contacting support.

Company-Initiated Termination:

  • The Company reserves the right to suspend or terminate accounts for violations of these Terms.
  • Accounts may be suspended for non-payment, fraudulent activity, or misuse of the Platform.
  • Users will be notified via email before account termination, except in cases of severe violations.

11. Third-Party Services

medplan.live integrates with third-party services to provide full functionality:

  • Stripe: We use Stripe for secure payment processing. By using our service, you also agree to Stripe's Terms of Service and Privacy Policy available at stripe.com.
  • The Company is not responsible for the availability, security, or performance of third-party services.
  • Third-party services may collect and process data independently; please review their privacy policies.

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the service will be uninterrupted, timely, secure, or error-free.
  • Any warranty regarding the accuracy, reliability, or completeness of content.

You use the Platform at your own risk. The Company does not guarantee that the Platform will meet your requirements or expectations.

13. Indemnification

You agree to indemnify, defend, and hold harmless Tymera Software LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

  • Your access to or use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights, including intellectual property rights.
  • Any inaccurate or unlawful data you input into the Platform.

14. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at support@medplan.live to attempt to resolve the dispute informally.

Arbitration: Any dispute arising from these Terms or the Platform will be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in class-action lawsuits or class-wide arbitration.

Jurisdiction: Any disputes not subject to arbitration shall be brought exclusively in the state or federal courts located in New Mexico, USA.
